A. General Terms and Conditions with Customer Information
1) Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") of Christine Huesch, trading as "The Happy Hue Studio" (hereinafter "Seller"), apply to all contracts for the provision of data created and supplied in digital form (digital content) that a consumer or business (hereinafter "Customer") concludes with the Seller via the e-commerce platform Etsy, regarding the digital content described by the Seller. The inclusion of the Customer's own terms is hereby objected to unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are not related to their commercial or self-employed professional activity.

1.3 A business within the meaning of these GTC is a natural or legal person or a legal partnership that acts in the course of its commercial or independent professional activity when concluding a legal transaction.

2) Conclusion of Contract
2.1 By listing a product on Etsy, the Seller makes a binding offer to provide the digital content.

2.2 The Customer may accept the Seller's offer using the online order form provided on Etsy. To do so, the Customer places the desired product in their virtual shopping cart and follows Etsy’s specified ordering steps. By clicking the final order button, the Customer declares acceptance of the offer, and a contract is formed for the selected digital content.

2.3 The contract text is stored by the Seller after the contract is concluded and sent to the Customer in text form (e.g., email, fax, or letter). The Seller does not provide any further access to the contract text.

2.4 Prior to submitting a binding order, the Customer can detect potential input errors by carefully reading the on-screen information. A helpful technical means is the browser’s zoom function. Inputs can be corrected using standard keyboard and mouse functions until the order is finalized by clicking the respective button.

2.5 The language available for concluding the contract is German.

3) Right of Withdrawal
Consumers generally have a right of withdrawal. Further details are provided in the Seller’s cancellation policy.

4) Prices and Payment Terms
4.1 All prices stated by the Seller are total prices. VAT is not charged as the Seller qualifies as a small business exempt from VAT.

4.2 Additional costs may apply for payments made from outside the EU (e.g., transfer or currency conversion fees), which are the Customer’s responsibility.

4.3 Available payment methods are specified in the Seller’s Etsy listing.

4.4 Payments made via "Etsy Payments" are processed by Etsy Ireland UC or, if in USD or CAD, by Etsy Inc. They may use third-party services. Available payment methods are displayed during the checkout process. Further details and Etsy Payments’ terms can be found at: etsy.com/legal/etsy-payments

4.5 If prepayment by bank transfer is agreed upon, the payment is due immediately after contract conclusion unless another due date has been agreed upon.

5) Provision of Content
Digital content is provided via email or download.

6) Granting of Usage Rights
6.1 Unless otherwise stated, the Seller grants the Customer a non-exclusive, unlimited license to use the digital content for private and commercial purposes.

6.2 Sharing with third parties or creating copies outside the agreed scope is not permitted unless the Seller has approved the license transfer.

6.3 For one-time delivery agreements, the rights are granted only after full payment. The Seller may permit temporary use prior to full payment, but no rights transfer occurs until payment is complete.

7) Liability for Defects
Statutory liability for defects applies.

8) Applicable Law
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. This applies to consumers only if the protection provided by mandatory laws of the consumer’s country of residence is not withdrawn.

9) Alternative Dispute Resolution
The Seller is neither obligated nor willing to participate in a consumer arbitration process.

10) Code of Conduct
The Seller adheres to the participation terms of the “Fairness in Commerce” eCommerce initiative, available at: fairness-im-handel.de/teilnahmebedingungen/
